Western and Central Pacific Fisheries for Highly Migratory Species; Transshipping, Bunkering, Reporting, and Purse Seine Discard Requirements

Abstract: At its Sixth Regular Session, in December 2009, the Commission for the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific Ocean (Commission) adopted provisions for transshipments of highly migratory species (HMS) fish in the Commissions area of competence and of HMS fish caught in the Commissions area of competence but transshipped elsewhere, as well as provisions regarding bunkering and other support activities with certain vessels and provisions regarding the reporting of discards from purse seine fishing vessels. At its Seventh Regular Session, in December 2010, the Commission adopted provisions for a high seas special management area. This rule implements these decisions adopted by the Commission by establishing the following: reporting requirements for transshipments of HMS fish in the Commissions area of competence and of fish caught in the Commissions area of competence but transshipped elsewhere; requirements to provide prior notice of transshipments on the high seas; requirements to provide notice of emergency transshipments that would otherwise be prohibited; requirements for observer coverage for transshipments at sea; prohibitions on transshipments and bunkering and other support activities with certain foreign-flagged vessels; requirements to provide notice before entering and exiting a high seas special management area; reporting requirements for discards of catch from purse seine vessels; and requirements regarding net sharing between purse seine vessels.
